Terms of Service

You must be at least 18 years of age to create an account or use the Service. By creating an account, you represent and warrant that you are 18 or older. We do not knowingly allow accounts to be created by persons under 18. If we learn that a user is under 18, we will terminate their account immediately.

In compliance with the Children’s Online Privacy Protection Act (COPPA), we do not knowingly collect personal information from children under 13. Photos of children may be shared by adult account holders acting on behalf of their families; by uploading such photos, you confirm that you are the parent or legal guardian of any child depicted, or that you have obtained appropriate consent.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at legal@familyedition.com if you suspect unauthorized access. You may not transfer your account to another person.

You agree to provide accurate, current, and complete information when creating your account and to keep that information up to date.

FamilyEdition allows family members to share photos and personal messages within a private, closed family group. At a scheduled cadence, submitted content is compiled into a professionally designed printed booklet (“Glimpse”) that is physically mailed to the address on file for the family. The Service is currently available in the United States. International availability may be added in the future.

The Service is offered on a recurring monthly subscription basis. Subscription fees are charged to the payment method on file at the start of each billing cycle. All fees are stated in US dollars. Prices are subject to change with 30 days’ notice.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not offer partial-month refunds.

Family Treasury. The Service includes an optional pre-funded treasury balance per family (“Treasury”). Treasury funds are a closed-loop credit balance that can only be applied toward print orders within the Service. Treasury funds are non-refundable, cannot be withdrawn as cash, and cannot be transferred between families or to other accounts. We reserve the right to expire unused Treasury balances after 24 months of account inactivity.

Payments are processed by Stripe, Inc. By providing payment information, you also agree to Stripe’s Terms of Service. We do not store full payment card numbers.

You retain ownership of all photos, captions, and other content you upload to the Service (“User Content”). By uploading User Content, you grant FamilyEdition a non-exclusive, royalty-free, worldwide license to store, process, render, compile, print, and deliver your User Content solely for the purpose of providing the Service to you and your family group. This license does not include any right to use your User Content in marketing, advertising, or any other purpose without your express written consent.

We will never use your photos to train artificial intelligence models without your explicit, separate opt-in consent.

You represent and warrant that:

• You own or have the rights to all User Content you upload;
• Your User Content does not infringe the copyright, trademark, privacy, or other rights of any third party;
• You have obtained the consent of any identifiable person depicted in your User Content (or, for minors, the consent of their parent or guardian).

You agree not to use the Service to:

• Upload content that is illegal, obscene, defamatory, harassing, or that infringes any third party’s rights;
• Upload photos of individuals without their knowledge or consent;
• Impersonate any person or entity;
• Attempt to gain unauthorized access to any part of the Service or other users’ accounts;
• Reverse-engineer, decompile, or disassemble any part of the Service;
• Use the Service for any commercial purpose other than as expressly permitted by these Terms;
• Violate any applicable local, state, national, or international law or regulation.

We reserve the right to remove any User Content that violates these Terms and to suspend or terminate accounts of users who repeatedly violate these Terms.

We respect intellectual property rights. If you believe that content available through the Service infringes your copyright, you may submit a DMCA takedown notice to our registered DMCA agent at:

Your notice must include: (1) identification of the copyrighted work claimed to be infringed; (2) identification of the allegedly infringing material; (3) your contact information; (4) a statement of good-faith belief that the use is not authorized; (5) a statement under penalty of perjury that the information is accurate and you are the copyright owner or authorized to act on their behalf; and (6) your physical or electronic signature.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

We do not guarantee exact color reproduction in printed materials. Print quality is subject to the capabilities of our print partners. We are not responsible for delays in postal delivery caused by USPS or other carriers outside our control.

TO THE FULLEST EXTENT PERMITTED BY LAW, FAMILETTER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100.

Informal Resolution. Before initiating any formal dispute, you agree to contact us at legal@familyedition.com and give us 30 days to attempt to resolve the issue informally.

Binding Arbitration. If we cannot resolve a dispute informally, you and FamilyEdition agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Service through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Delaware. The arbitrator’s decision will be final and binding.

Class Action Waiver. You agree that any arbitration or proceeding shall be limited to the dispute between us individually. To the fullest extent permitted by law, you waive the right to participate in a class action lawsuit or class-wide arbitration.

Exceptions. Either party may seek emergency injunctive relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration, without waiving the right to arbitration.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Subject to the arbitration clause above, you consent to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute not subject to arbitration.

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including sections on User Content, liability, dispute resolution, and governing law.

You may terminate your account at any time by contacting us or using the account deletion feature in the app. Termination does not entitle you to a refund of unused subscription fees or Treasury balances.

We may update these Terms from time to time. When we do, we will post the revised Terms with an updated effective date and notify you via email or in-app notification at least 14 days before material changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and FamilyEdition regarding the Service and supersede all prior agreements.

Severability. If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force.

No Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
