Terms of Service

These Terms of Service (“Terms”) govern your use of the Family Edition mobile application and website (collectively, the “Service”) operated by Family Edition LLC (“Family Edition,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility & Age Requirement

You must be at least 13 years of age to create an account or use the Service. By creating an account, you represent and warrant that you are 13 or older. We collect your date of birth at sign-up to verify this requirement. If we learn that a user is under 13, we will immediately terminate their account and permanently delete all associated data.

Adult responsibility. Family Edition is designed as an adult-managed service. We strongly encourage account holders to be 18 or older (or the age of majority in their jurisdiction). Adult account holders are solely responsible for all content uploaded, shared, or transmitted through their accounts.

No child accounts. You are strictly prohibited from creating accounts for, or sharing account credentials with, any person under the age of 13. Do not create “sub-accounts” or “child profiles” that allow a minor to log in, upload content, or interact with the Service directly. Children may only view printed physical editions produced by an adult account holder — they must never interact with the Service directly.

Photos of minors. In compliance with the Children’s Online Privacy Protection Act (COPPA), we do not knowingly collect personal information from children under 13. If an adult account holder uploads photos of minors, that adult represents and warrants that they are the parent or legal guardian of any child depicted, or that they have obtained explicit parental or guardian consent to privately host those images through the Service.

Age gate. We use a date-of-birth gate at registration. If you are blocked for being underage, you may not circumvent this restriction by re-entering false information. Doing so is a material breach of these Terms and will result in immediate account termination.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately via our support page if you suspect unauthorized access. You may not transfer your account to another person.

You agree to provide accurate, current, and complete information — including your date of birth — when creating your account and to keep that information up to date. Providing a false date of birth to circumvent the age requirement is a material breach of these Terms.

3. The Service

Family Edition allows family members to share photos and personal messages within a private, closed family group. At a scheduled cadence, submitted content is compiled into a professionally designed printed edition that is physically mailed to the address on file for the family. The Service is currently available in the United States. International availability may be added in the future.

4. Subscriptions & Payments

The Service is offered on a recurring monthly subscription basis. Subscription fees are charged to the payment method on file at the start of each billing cycle. All fees are stated in US dollars. Prices are subject to change with 30 days’ notice.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not offer partial month refunds.

Family Fund. The Service includes an optional pre-funded family fund balance per circle (“Family Fund”). Family Fund credits are a closed loop balance that can only be applied toward print orders within the Service. Family Fund credits are nonrefundable, cannot be withdrawn as cash, and cannot be transferred between circles or to other accounts. We reserve the right to expire unused Family Fund balances after 24 months of account inactivity.

Payments are processed by Stripe, Inc. By providing payment information, you also agree to Stripe’s Terms of Service. We do not store full payment card numbers.

5. User Content & License

You retain ownership of all photos, captions, and other content you upload to the Service (“User Content”). By uploading User Content, you grant Family Edition a nonexclusive, royalty free, worldwide license to store, process, render, compile, print, and deliver your User Content solely for the purpose of providing the Service to you and your circle. This license does not include any right to use your User Content in marketing, advertising, or any other purpose without your express written consent.

We will never use your photos to train artificial intelligence models without your explicit, separate opt in consent.

You represent and warrant that:

  • You own or have the rights to all User Content you upload;
  • Your User Content does not infringe the copyright, trademark, privacy, or other rights of any third party;
  • You have obtained the consent of any identifiable person depicted in your User Content (or, for minors, the consent of their parent or guardian).

6. Acceptable Use

You agree not to use the Service to:

  • Upload content that is illegal, obscene, defamatory, harassing, or that infringes any third party’s rights;
  • Upload photos of individuals without their knowledge or consent;
  • Impersonate any person or entity;
  • Attempt to gain unauthorized access to any part of the Service or other users’ accounts;
  • Reverse engineer, decompile, or disassemble any part of the Service;
  • Use the Service for any commercial purpose other than as expressly permitted by these Terms;
  • Violate any applicable local, state, national, or international law or regulation.

We reserve the right to remove any User Content that violates these Terms and to suspend or terminate accounts of users who repeatedly violate these Terms.

7. Child Safety Standards

Family Edition has zero tolerance for child sexual abuse and exploitation (“CSAE”) in any form. This includes, without limitation, child sexual abuse material (CSAM), grooming, sextortion, trafficking of minors, and any other content or conduct that sexualizes or endangers a child. This prohibition applies regardless of the private, closed-circle nature of the Service and is in addition to the restrictions in Section 6, Acceptable Use.

Reporting. If you encounter content or behavior on the Service that you believe constitutes CSAE, report it immediately via our support page. Reports may be submitted by anyone, whether or not you hold an account, and we do not require you to be the affected family circle’s account holder to report a concern.

Our response. Upon becoming aware of CSAE content or conduct on the Service, we will immediately remove the content, permanently terminate the accounts involved, preserve relevant records as required by law, and report the matter to the National Center for Missing & Exploited Children (NCMEC) via its CyberTipline and to law enforcement, as required under 18 U.S.C. § 2258A and other applicable law.

8. Copyright & DMCA

We respect intellectual property rights. If you believe that content available through the Service infringes your copyright, you may submit a DMCA takedown notice to our registered DMCA agent at:

Your notice must include: (1) identification of the copyrighted work claimed to be infringed; (2) identification of the allegedly infringing material; (3) your contact information; (4) a statement of good faith belief that the use is not authorized; (5) a statement under penalty of perjury that the information is accurate and you are the copyright owner or authorized to act on their behalf; and (6) your physical or electronic signature.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

We do not guarantee exact color reproduction in printed materials. Print quality is subject to the capabilities of our print partners. We are not responsible for delays in postal delivery caused by USPS or other carriers outside our control.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FAMILY EDITION LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100.

12. Dispute Resolution & Arbitration

Informal Resolution. Before initiating any formal dispute, you agree to contact us via our support page and give us 30 days to attempt to resolve the issue informally.

Binding Arbitration. If we cannot resolve a dispute informally, you and Family Edition agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Service through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Delaware. The arbitrator’s decision will be final and binding.

Class Action Waiver. You agree that any arbitration or proceeding shall be limited to the dispute between us individually. To the fullest extent permitted by law, you waive the right to participate in a class action lawsuit or classwide arbitration.

Exceptions. Either party may seek emergency injunctive relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration, without waiving the right to arbitration.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Subject to the arbitration clause above, you consent to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute not subject to arbitration.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including sections on User Content, liability, dispute resolution, and governing law.

You may terminate your account at any time by contacting us or using the account deletion feature in the app. Termination does not entitle you to a refund of unused subscription fees or Family Fund balances.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised Terms with an updated effective date and notify you via email or in app notification at least 14 days before material changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

16. Miscellaneous

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Family Edition regarding the Service and supersede all prior agreements.

Severability. If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force.

No Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
